Court Findings: The Federal Court of Australia found the respondents contravened s.38 of the BCII Act by engaging in unlawful industrial action and s.43 of the BCII Act by attempting to coerce Abigroup to employ certain workers at the Monash Freeway and Southern Link Projects in May 2008.

Court Outcome: The Federal Court imposed penalties on 7 March 2011 totalling $170,000 on the CFMEU and nine of its officials. Details of the penalties can be found in the attached judgement.
