Court Findings: The Federal Court of Australia found L. U. Simon Builders Pty Ltd had contravened s45 of the BCII Act when it refused to allow Mr Peter Vanderkley and his employee entry to the Aquavista site located at Docklands, Victoria on 6, 9 and 22 March 2007 on the grounds that je did not have a workplace agreement with the CFMEU.
Court Outcome: On 17 February 2009 Justice Marshall ordered L.U. Simon Builders Pty Ltd to pay penalties totalling $55,000.
