Independent contractors

When you engage someone to do work for you, it is important to know whether you are engaging the person as an employee or a contractor.

Employee or contractor

Employees and contractors are two very different classifications in the building and construction industry. This page provides information about some of the differences between the two and a summary of the relevant common law test.

Contractor's rights

Under the Independent Contractors Act 2006 (IC Act), independent contractors are able to seek relief if they perform work on terms that are ‘unfair’ or ‘harsh’.
