In general, a building industry participant is a:

  • building employee
  • building employer
  • building contractor
  • person who enters into a contract with a building contractor to undertake building work
  • building association like a union or employer association
  • representative of a building association

Building work includes most commercial construction activities.

Building work does not include activities associated with the construction, repair or restoration of domestic housing, except if the project is part of a development that consists of at least five single-dwelling houses.

If there is a work health and safety issue on a building site, you should contact the relevant authority immediately.

The ABCC can assist with building work as defined by the BCIIP Act and the Code, which includes most commercial construction activities.

  • Contractual disputes between homeowners and builders
  • Fencing disputes
  • Domestic construction defects.

Code covered entities must report any disputed or delayed progress payments to the ABC Commissioner and relevant funding entity (if any) as soon as practicable after the date on which the payment falls due.
