19 July 2016Reminder: “good faith” pay increases are a breach of the Building Code

In recent days advice has been circulated to building industry participants in Victoria to the effect that contractors “are free to choose to pass on a pay increase should they wish – provided that this is a decision they make voluntarily, and independently of any third party.

FWBC again wishes to bring to the attention of building industry participants our E-Alert issued 10 March 2016, which warned that contractors who operate outside the scope of their enterprise agreement are in breach of the Building Code 2013.

Specifically, FWBC reminds industry participants that enacting a “good faith” pay increase that is not part of a registered enterprise agreement is a breach of section 10 of the Building Code 2013.

Building industry participants who are considering entering into enterprise agreements are encouraged to send any queries to agreementquestions[at]fwbc.gov.au.
