Since 1 September 2018, new reporting obligations have applied under the Building Code 2016 that require all disputed and delayed payments to subcontractors to be reported to the ABCC as soon as practicable after the date on which the payment falls due.
This has resulted in a 220 per cent increase in security of payment enquiries––from 36 per quarter in 2017-18 to 115 in the first quarter of 2018-19.
In the first five months of the 2018/19 financial year, the ABCC has received 138 reports of disputed or delayed progress payments and 23 complaints which equates to over $27.9 million in alleged disputed or delayed payments.
The figures are off the back of the nation-wide campaign the ABCC launched on 16 July this year. As part of the campaign the Commissioner wrote to more than 1,300 contractors and subcontractors who tendered for Commonwealth funded work outlining their rights and responsibilities.
