Welcome to the last edition of Industry Update for 2016, and the first from the Australian Building and Construction Commission (ABCC) since we transitioned from our predecessor agency Fair Work Building and Construction on 2 December 2016.

In addition to the usual updates on the agency’s activities before the Courts and the Fair Work Commission, this edition of Industry Update provides useful information on obtaining letters of compliance and preliminary advice in relation to the Code for the Tendering and Performance of Building Work 2016 (Building Code 2016), as well as arrangements for contacting the ABCC during the holiday period.

As always, 2016 has been a busy and productive year for the agency. Last financial year saw us commence the second highest number of legal proceedings in a financial year in the history of FWBC and its predecessor agencies; manage a 17 per cent increase in the number of enquiries received; and exceed $1.8 million in penalties awarded in matters commenced by the agency.

Our commencement as the ABCC on 2 December 2016 has seen the agency’s remit expand with the assumption of a number of additional functions. Along with the agency’s new functions, the ABCC will continue to progress all matters that were commenced by FWBC prior to the agency’s transition. We will continue to keep you informed of any important changes as we undergo this transition, including the launch of our new website in January.
