FWBC Courts Wrap-Up

Here is an update of matters lodged in the courts in November:

 

NEW CASES FILED WITH THE COURTS

Suspend CFMEU SA state secretary Aaron Cartledge’s permit says FWBC

  • FWBC has applied for four CFMEU officials, including SA State Secretary Aaron Cartledge, to have their right of entry permits revoked or suspended.
  • FWBC has put to the Fair Work Commission that the officials should also be banned from being issued a permit for up to two years.
  • The applications were made after the Federal Court recently penalised the CFMEU and the officials a total of $152,600 for breaching right of entry laws.
  • The officials had all admitted to intentionally hindering and obstructing Hansen Yuncken site managers at the $75 million Cbus construction site in Flinders Street, Adelaide.

CFMEU’s Mick Powell facing Federal Court over Aquanation site entries

  • FWBC has launched Federal Court proceedings against CFMEU organiser Michael Powell for four alleged right of entry breaches at the $45 million Aquanation project in Ringwood, Victoria.
  • The Maroondah City Council Aquanation facility will feature a 10 lane pool, warm water pool, leisure play pool, gym, child care facilities, café and State Diving Centre.
  • On four dates in 2014, Mr Powell entered the site to assist the elected health and safety representative, without holding a Federal right of entry permit.
  • Mr Powell was asked to produce his right of entry permit on three of the occasions, but failed to do so.
