End of Financial Year Legal Wrap Up

FWBC was successful in 100 per cent of judgements in our court cases last financial year.

As the regulator of workplace relations laws in Australia’s construction industry, FWBC investigates alleged breaches of the Fair Work Act 2009 (FW Act) and initiates civil litigation proceedings if the evidence warrants.

Between 1 July 2012 and 1 July 2013, FWBC has:

  • been successful in 100 per cent of our court judgements (nine cases in total)
  • secured $917,160 in penalties as a result of those judgements
  • won $101,930 in compensation for subcontractors and
  • commenced twelve new proceedings.

We had 22 matters before the courts as at 1 July 2013 and 97 active investigations.

The matters under investigation include alleged unlawful industrial action, coercion, sham contracting, right of entry contraventions, underpayment of wages and entitlements and freedom of association contraventions.
