Code covered entities must comply with all designated building industry laws.
Code requirements relate to:
- eligibility to tender for Commonwealth funded building work and tendering practices
- reporting requirements
- compliance with right of entry
- coercion, etc.
Code covered entities must comply with all designated building industry laws, such as the Fair Work Act. Once a tender or expression of interest has been submitted for Commonwealth funded building work, that entity and its related entities becomes “code covered entities”.
There are particular requirements under the Code for Commonwealth funded building work such as the eligibility to tender, Workplace Relations Management Plans for head contractors and drug and alcohol testing.
There are also requirements on all Code projects around collusive tendering practices, labour market testing, security of payment, freedom of association, reporting and coercion.
