Court Findings:

The Federal Magistrates Court found the AWU, CEPU, AMWU and three union representatives’ contravened s38 of the BCII Act at the Maryvale Pulp Mill expansion project. On 5 February 2008, AMWU Organiser Steve Dodd held a meeting with employees of BMC, a contractor at the site, which was scheduled to finish at 10.10am. The meeting ran overtime and site management asked Mr Dodd to end the meeting.  Mr Dodd reconvened the meeting outside the project gate and the majority of those employees did not return to work for the remainder of the day.

Court Outcome:

On 25 August 2009 Federal Magistrate Burchardt imposed penalties of $5,800 on the AMWU and $1,200 on Dodd.
