Summary of court decision

On 22 March 2017 the application for liability was dismissed by the Federal Court.

On 26 April 2017 the ABCC filed a Notice of Appeal to the Full Court of the Federal Court of Australia, which was heard in late July/early August 2017.

On 31 May 2018 the Full Court of the Federal Court of Australia dismissed the ABCC’s appeal.

Background:

The ABCC* commenced proceedings in the Federal Court in 2015 against CFMEU ACT secretary Dean Hall and seven CFMEU officials in relation to allegations of contravention of coercion provisions. The Federal Court dismissed the ABCC’s proceeding. An appeal by the ABCC was dismissed in 2018.

*This matter was originally filed by Fair Work Building and Construction (FWBC). On 2 December 2016, FWBC became the ABCC.
