The Full Court of the Federal Court has today confirmed that union officials require a valid federal right of entry permit to enter a site under a State or Territory occupational health and safety law, including where a health and safety representative (HSR) invites the official on to site under an OHS law.

Legal Case
The ABCC filed proceedings in the Federal Court on 16 September 2020 alleging the CFMMEU and two of its officials committed 46 contraventions when they disrupted night construction work and ignored Victoria Police and WorkSafe instructions at the $6.7 billion West Gate Tunnel Project in December 2019.

Our corporate structure The ABCC is led by the Australian Building and Construction Commissioner, who is appointed by the Minister. Deputy Commissioners, who are also appointed by the Minister, assist the Commissioner. Stephen McBurney was appointed as Commissioner for five years, commencing in February 2018.

Legal Case
The ABCC has filed Federal Court proceedings against the CFMMEU and one of its officials, Stephen Parker, for alleged breaches of right of entry laws in the Fair Work Act 2009 at the NEXT DC P2 Project in Perth in December 2019.
