Building industry participant

Building industry participant means any of the following:

  • a building employer
  • a building employee
  • a building contractor
  • a person who enters into a contract with a building contractor under which the building contractor agrees to carry out building work or to arrange for building work to be carried out
  • a building association
  • an officer, delegate or other representative of a building association.
Legal Case
On 20 November 2015, the court handed down its liability decision finding all alleged contraventions were proven. A penalty decision was handed down on 22 April 2016. Penalties totalling $494,150 were imposed on the respondents.

Legal Case
The Court found that Ryan Whakauru contravened section 417 of the Fair Work Act 2009 on 11 and 12 September 2014 when he refused to perform work at the QUT Creative Industries Precinct Project. Mr Whakauru was penalised $7,500 for the two contraventions.
