Building industry participant

Building industry participant means any of the following:

  • a building employer
  • a building employee
  • a building contractor
  • a person who enters into a contract with a building contractor under which the building contractor agrees to carry out building work or to arrange for building work to be carried out
  • a building association
  • an officer, delegate or other representative of a building association.

Our corporate structure The ABCC is led by the Australian Building and Construction Commissioner, who is appointed by the Minister. Deputy Commissioners, who are also appointed by the Minister, assist the Commissioner. Stephen McBurney was appointed as Commissioner for five years, commencing in February 2018.

In response to queries, the ABCC provides the following guidance to code covered entities on their obligations under section 16 of the Code for the Tendering and Performance of Building Work 2016. Section 16 of the Code does not require any action to be taken where an employer has authorised the absence of their workers.
