Building industry participant

Building industry participant means any of the following:

  • a building employer
  • a building employee
  • a building contractor
  • a person who enters into a contract with a building contractor under which the building contractor agrees to carry out building work or to arrange for building work to be carried out
  • a building association
  • an officer, delegate or other representative of a building association.

Industrial action is primarily regulated under the Fair Work Act 2009 (FW Act). But industrial action in relation to building work is subject to more rules under the Building and Construction Industry (Improving Productivity) Act 2016 (BCIIP Act).

On 20 November 2015, the Federal Court handed down its liability decision finding all alleged contraventions were proven. A penalty decision was handed down on 22 April 2016 with penalties totalling $54,200.
