FWBC had issued proceedings against Baulderstone Pty Limited, Gregory Lemin, Raz Razzlog and Nicole Kidman for allegedly representing to an employee that he had to cease employment under a contract and be re-engaged under Baulderstone’s 2009 Agreement. The respondents allegedly told the employee that he had to resign his employment under the Contract by signing a resignation letter, a termination record and a re-engagement record. The respondents allegedly said the employee would receive more money under the Agreement.
FWBC had alleged that the respondents contravened section 345 of the by making false or misleading representations to an employee about the employee’s workplace right.
FWBC had alleged that the respondents contravened section 346 of the FW Act by dismissing the employee, injuring the employee in his employment and/or altering his position to his prejudice.
Further, or in the alternative, it had been alleged that Mr Lemin, Mr Razzlog and Ms Kidman were involved in the contraventions of section 345 and 346 of the FW Act by the other Respondent through their involvement in the contraventions.
