DFWBII v Vic Metro Brick and Blocklaying Pty Ltd & Ors (No.2) FCCA 3223 (9 December 2015)
FWBC filed proceedings in the Federal Circuit Court against Vic Metro Brick and Blocklaying Australia following allegations that the company had failed to pay wages and entitlements, including travel allowances and annual leave, to five of its employees.
FWBC initiated these proceedings in 2013, prior to responsibility for wage and entitlement matters being transferred to the Fair Work Ombudsman.
The court found that Vic Metro Brick and Blocklaying Australia underpaid the five employees and ordered the company to repay $6105.23 in unpaid wages, including interest. In delivering her decision, Judge Riley found that three of the five affected workers were particularly vulnerable due to their status as foreign nationals. The company was fined $19,250.
