Court Findings:

The Federal Magistrates Court found that the CFMEU and its organiser Derek Christopher engaged in industrial action in contravention of s38 of the Building and Construction Industry Improvement Act 2005 at the Brookfield Multiplex Ltd SX2 Project at 111 Bourke Street, Melbourne in March 2010.

During 2010 Brookfield Multiplex Ltd engaged subcontractors for the SX2 project, including Gemwood Installations Pty Ltd.

On 12 March 2010, CFMEU official Derek Christopher entered the SX2 Project and addressed employees of Multiplex and its subcontractors and directed them to stop working at the site.

Workers left the SX2 Project site following the meeting on 12 March 2010 and did not return that day.

Court Outcome:

Burchardt FM imposed a penalty of $20,000 on the CFMEU and a penalty of $8,000 on Christopher.
