Allegations as outlined in Fair Work Building & Construction’s (FWBC) statement of claim, these may vary over the course of the proceeding.

  1. FWBC has issued proceedings in the Federal Court of Australia against the Construction, Forestry, Mining and Energy Union (CFMEU) and CFMEU official Joseph Myles.
  2. FWBC alleges the CFMEU and Mr Myles took action or threatened to take action with the intention of coercing the head contractor at the $140 million Mitcham and Rooks Road Rail Separation Project (the Project) to engage a CFMEU delegate.

10 July 2013

  1. FWBC alleges Mr Myles met with the Project General Manager and Project Superintendent. It is alleged Mr Myles said words to the effect: “the CFMEU wants representation on the Project”.

1 August 2013

  1. It is alleged Mr Myles again met with the Project General Manager and Project Superintendent and said the CFMEU wanted representation on the Project site.
  2. FWBC alleges Mr Myles put two names forward and said he expected there to be CFMEU representation within one week.
  3. It is alleged Mr Myles indicated that if there was not CFMEU representation on the Project then there would be “war”.
  4. It is further alleged Mr Myles said it would be easy for him to mobilise “100 guys” at the Project’s gate.

22 August 2013

  1. FWBC alleges Mr Myles attended the site from on or around 6.15am, and, in the company of several other persons in CFMEU clothing directed, advised, counselled, encouraged, induced, incited or procured the employees of the subcontractors not to work at the Project site that day.
