CFMEU officer Bradley Upton facing court in FWBC case

A CFMEU officer who allegedly told a Bechtel representative “that’s the AWU way, we don’t do things that way. We do things the f**king CFMEU way,” and also told another representative to hit him, is facing court.

FWBC has launched proceedings in the Federal Court against Bradley Upton, the CFMEU and the CFMEUW over the alleged incident at the Wheatstone project in Western Australia.

FWBC alleges Upton went on site on October 8, 2012, to meet with employees at the project and after being escorted to the meeting room said the venue was “no good” and said he was going to the Bechtel offices.

It is alleged that Upton was told he could pursue legal options through Fair Work Australia if there were issues with the venue.

FWBC alleges Upton then said words to the effect: “That’s the AWU way, we don’t do things that way. We do things the f**king CFMEU way.”

It is alleged Upton then spoke to another Bechtel representative and said words to the effect: “Is this sh*thole place acceptable to you? Is this sh*thole good for you f**king Americans? This is not f**king America. You think you can treat us like sh*t, you f**king Americans. Australians won’t stand for this. You f**king Americans can’t push us around like we’re pieces of sh*t. We won’t put up with you f**king Americans here, not here”.

FWBC alleges when the representative did not respond Upton stepped closely towards his face and said words to the effect of: “You want to hit me? Go ahead and hit me, you f**king American. Come on and hit me you f**king American. Hit me, go ahead.”

It is alleged Upton returned to the site on 13 February, 2013, and again said the meeting room was not fit for purpose. It is alleged Upton disregarded the warning it would be trespassing if he went elsewhere on site and held discussions with employees in the wet mess area of the project.

FWBC director Nigel Hadgkiss said this kind of conduct will not be tolerated. “FWBC will not hesitate to bring people who behave like this before the courts.”
