These scenarios have been developed to help contractors to understand the interaction between the two Building Codes.

This table sets out a contractor’s eligibility to express interest in, tender for and be awarded a contract for Commonwealth funding building work and the documents required to demonstrate eligibility. It provides a number of different scenarios to assist contractors understand when they can use a self-declaration and when they need a letter of compliance.

Before submitting a registered enterprise agreement for assessment, using this list will help you understand whether your agreement meets the requirements of the Building Code. Many contractors choose to submit a proposed agreement for preliminary advice in order to expedite the process.

Form Description

Building Code 2016 Advice Request/Letter of Compliance Form 

You must use this form to submit your registered agreement to the ABCC for assessment, or to receive preliminary advice on your draft agreement.

Self-Declaration A

This Self Declaration can be used to express interest in, tender for and be awarded Commonwealth funded building work by contractors whose employees on the project will be covered by:

  • a Modern Award or other lawful arrangement; or
  • an enterprise agreement made before 25 April 2014 that has not since been varied in accordance with section 207 of the Fair Work Act 2009.

Contractors are also required to submit a Declaration of Compliance including Attachment A Mandatory Information.  In this Declaration, contractors are required to list all of the enterprise agreements made or varied on or after 25 April 2014 that cover the contractor and its related entities and reference the evidence that demonstrates the compliance of these agreements. This documentation will be provided by the entity issuing the tender to the contractor during the tender the process to complete.

Self-Declaration C

This Self-Declaration can be used by:

  • Contractors tendering for work between 2 December 2016 and 16 February 2017 (inclusive) who are covered by an enterprise agreement made on or after 25 April 2014 but before 2 December 2016 and who fall into one of the following categories:

    • Category 1: not also covered by an enterprise agreement made on or after 2 December 2016; or

    • Category 2: also covered by an enterprise agreement made on or after 2 December 2016.

This Self Declaration can be used to be awarded and undertake Commonwealth funded building work until 29 November 2018. However, a Letter of Compliance is also required for any enterprise agreement made on or after 2 December 2016 that covers the contractor.
