Court Findings:

The Federal Magistrates Court found the CFMEU and Mr Primmer each contravened s.800(1)(a) of the Workplace Relations Act 1996 by encouraging the head contractor at the Kiama High School site in NSW to take discriminatory action against a painting subcontractor on 12 October 2006.

Court Outcome:

On 3 November 2008, Federal Magistrate Cameron imposed penalties totalling $10,000 on the CFMEU and penalties totalling $3,500 on Mr Primmer.
