FWBC enforces workplace relations laws in the building and construction industry through the provision of education, advice and compliance activities. This is in accordance with the Fair Work (Building Industry) Act (FWBI Act), the Fair Work Act 2009 (FW Act), the Independent Contractors Act 2006 and the Building Code 2013.
The main object of the FWBI Act (at s.3) is:
“...to provide a balanced framework for cooperative, productive and harmonious workplace relations in the building industry by:
(a) ensuring compliance with workplace relations laws by all building industry participants; and
(b) providing information, advice and assistance to all building industry participants about their rights and obligations; and
(c) providing an effective means of enforcing those rights and obligations; and
(d) providing appropriate safeguards on the use of enforcement and investigative powers; and
(e) improving the level of occupational health and safety in the building industry.”
In order to achieve the object of the FWBI Act and ensure compliance with the above laws, FWBC undertook the following activities in 2013-14:
provided education, assistance and advice to industry participants;
conducted targeted educational and compliance activities;
conducted investigations into alleged breaches of workplace laws;
commenced civil penalty litigation; and
provided ready-access to information on relevant workplace laws.
