Fair Work Building & Construction (FWBC) is an independent statutory agency regulating workplace relations laws in the building and construction industry. FWBC commenced operations on 1 June 2012.
With the approval of the Minister for Workplace Relations, Fair Work Building & Construction is the usual operating name for the agency established by the Fair Work (Building Industry) Act 2012 (FWBI Act).
FWBC regulates workplace relations laws in the building and construction industry by providing education, advice and compliance activities. This is in accordance with the FWBI Act, the Fair Work Act 2009 (FW Act), the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009, the Independent Contractors Act 2006 (IC Act), The Building Code and the National Code of Practice for the Construction Industry (National Code).
FWBC aims to ensure that there is a balanced framework for cooperative, productive and harmonious workplace relations in the building and construction industry.
The main object of the FWBI Act at s.3 is:
“...to provide a balanced framework for cooperative, productive and harmonious workplace relations in the building industry by:
ensuring compliance with workplace relations laws by all building industry participants
providing information, advice and assistance to all building industry participants about their rights and obligations
providing an effective means of enforcing those rights and obligations
providing appropriate safeguards on the use of enforcement and investigative powers
improving the level of occupational health and safety in the building industry.”
The information provided in the 2012-13 FWBC Annual Report is in accordance with s.14 of the FWBI Act, which sets out the requirements for its contents and tabling. Information relating to delegations and recommendations made to the Director by the Advisory Board under ss. 14(2) (b) and 14(2)(c) respectively are not discussed in the main body of the report. This information is provided in Appendix 1.
Appendix 2 outlines the means by which FWBC achieves the main object of the FWBI Act and where the means are specifically addressed in the Annual Report.
