Ensuring compliance with workplace relations laws by all building industry participants

FWBC is committed to encourage lawfulness and compliance and provide the resources our industry needs to overcome their problems and create higher functioning workplaces. FWBC devotes considerable resources to advising building industry participants about their rights and obligations under Australian workplace laws. This activity encompasses material on the website, articles in the media, presentations by FWBC staff and promotional material. FWBC investigations and proceedings taken against parties alleged to have contravened the law ensure compliance by all building industry participants.

Providing information, advice and assistance to all building industry participants about their rights and obligations

FWBC devotes resources to informing building industry participants of their rights and obligations. This is done in a number of ways. Fair Work Building Industry Inspectors conduct presentations and education sessions to building industry participants of all levels. Regular alerts and a monthly newsletter are distributed via the FWBC database and are available on the FWBC website. The website contains a wide range of information and advice regarding industrial laws, regulations and the National Code.

SECTION 3(2)(C)

Providing an effective means of enforcing those rights and obligations

FWBC is an active and accessible regulator. FWBC devotes considerable resources to train investigatory and legal staff to ensure they are well-equipped for their roles. FWBC uses IT-based case management systems to ensure accurate recording of case developments and associated data.

SECTION 3(2)(D)

Providing appropriate safeguards on the use of enforcement and investigative powers

FWBC devotes considerable resources to train investigatory and legal staff to ensure they are well-equipped for their roles. FWBC commences legal proceedings where it is in the public interest and where there are reasonable prospects for success. FWBC ensures the legislative requirements on the use of its compliance powers are strictly adhered to.

SECTION 3(2)(E)

Improving the level of occupational health and safety in the building industry

This is primarily the responsibility of the Federal Safety Commissioner (FSC). FWBC liaises with the FSC and state and territory OHS agencies as appropriate.
