ABCC v Doyle and CFMEU
Applicant: Australian Building Construction Commissioner
Respondent(s): Fergal Doyle and Construction Forestry Mining & Energy Union (CFMEU)
Date filed: 29 October 2010
The Federal Magistrates Court found that the CFMEU contravened section 500 of the Fair Work Act 2009 by the actions of its official, Fergal Doyle, in hindering and obstructing workers after he exercised his right to enter the Mossgiel Park Primary School site in Victoria in October 2009.
Mr Doyle refused to attend the site office to sign in and refused to show the site manager his entry permit. The site manager contacted Victoria Police and the ABCC before again asking Mr Doyle to show his entry permit. Mr Doyle refused the request.
The Court imposed a penalty of $6,500 on the CFMEU. No penalties were imposed against Doyle.
