An application by Skilled Group Ltd (“Skilled”) under section 496 of the Workplace Relations Act 1996 for orders to stop or prevent industrial action in relation to an industrial dispute between the company and the AMWU and AWU.
Skilled’s application concerned industrial action by AMWU and AWU members engaged on work at the Viridian Glass plant at Dandenong where Skilled has a contract to perform shutdown and modification work.
Following a meeting with officials from the AMWU and AWU on 2 July 2008, employees commenced a ban on the working of rostered overtime in support of a number of issues the unions are pursuing.
Proceedings took place before Commissioner Blair on 3 July in which the company provided evidence as to the existence of the industrial action. The Commission was satisfied that industrial action in the form of overtime bans was in place and decided to issue an interim order that would run until 18 July 2008. At a further hearing on 17 July 2008 it was determined that since there was no industrial action occurring, no further substantive order was required.
