The matter concerned an application by Bovis Lend Lease for orders pursuant to s.496 of the Workplace Relations Act 1996 to stop or prevent industrial action at 3 sites at Melbourne’s Docklands precinct and the new Royal Children’s Hospital
The application concerned strike action at the four sites following meetings addressed by CFMEU officials. Building workers had been on strike in protest at the proposed introduction by the company of an integrated electronic safety and security management system for construction sites known as “Blue Glue”.
Bovis Lend Lease has recently implemented the safety management system across its sites globally and in Australia, except in Victoria. “Blue Glue” is a core part of Bovis Lend Lease’s commitment to safety on sites.
When proceedings commenced in the AIRC on 15 July 2008, the company advised the Commission that employees had returned to work that morning and the company did not want to press its application at that time. Bovis lend Lease sought an adjournment until the following day and advised that if it was satisfied that further industrial action was unlikely it would discontinue its application.
On 16 July 2008, Bovis Lend Lease informed the Commission that it no longer wished to proceed with its application and further proceedings in the AIRC were cancelled.
