Thiess sought an order under section 127 of the Workplace Relations Act 1996 binding the RTBU and relevant employees to prevent probable industrial action on the Craigieburn Rail Project in Victoria. The ABCC intervened in the matter and submitted that Commissioner Mansfield should exercise his discretion to grant the order sought by Thiess

On 24 February 2006 an interim order for a period of one week was granted. Thiess did not seek to extend that order.

Thiess also applied to revoke the right of entry permits of two union officials, one of the CFMEU and one of the RTBU. The applications were adjourned indefinitely after both unions gave undertakings to comply in future with the federal right of entry laws.
