Project Connection Australia applied under s.170MH of the pre-reform Workplace Relations Act 1996 (WR Act) for termination of the Project Connection Australia Pty Ltd Enterprise Agreement 2003 in the public interest in order to be Code compliant. The applicant was represented by NECA NSW.
The agreement had been made pursuant to s.170LK of the pre reform WR Act, an agreement between the company and employees. The nominal expiry date of the agreement was 5 February 2007.
AIRC proceedings took place on 2 August 2007. The company submitted that it would not be contrary to the public interest if the Commission terminated the agreement and it gave an undertaking that any employee to whom the agreement applied would continue to enjoy the benefits of the agreement. The ABCC supported the submissions of the employer. Commissioner Redmond ruled that it would not be contrary to the public interest to terminate the agreement and ordered that it be terminated with effect from 2 August 2007.
