Bell Scaffolding Pty Ltd applied to have an Agreement with the CFMEU certified under section 170LJ of the Workplace Relations Act 1996. The CFMEU opposed the application and refused to sign the Agreement, despite the employer's submission that a valid majority of employees had voted in favour of the Agreement.
The ABCC provided a statement to support the claim that a valid majority of employees had voted in favour of the Agreement.
In the circumstances, the employer decided not to proceed with the hearing on 7 March and the matter was adjourned until further application.
