Have you notified the ABCC of your court application or outcome?

As a building industry participant you should be aware of changes to the Building and Construction Industry Improvement Act 2005 (BCII Act) regarding your obligation to notify the ABCC of court proceedings you are involved in.

In court cases relating to building work, you must notify the ABC Commissioner when you apply to the court pursuant to the BCII Act, the Workplace Relations Act 1996 or the Independent Contractors Act 2006. This includes court cases where the application is made by another party.

You must also notify the ABC Commissioner of the outcome of the court proceedings at it’s conclusion.

The requirement to notify the ABC Commissioner extends to applications to the Federal Court, Federal Magistrates Court and any State Court.
