The Office of the Australian Building and Construction Commissioner (ABCC) today released its fifth report on the use of its compliance powers. The ABCC regularly reports on the use of its compliance powers. The latest report covers the period 1 October 2005 to 30 September 2008.
This report updates the information contained in the fourth report of 31 March 2008. Since 1 October 2005 the ABCC has issued 142 notices to attend and answer questions. It has also issued four notices requiring the production of documents.
A breakdown by state reveals that 78 examinations have been conducted since 1 October 2005 in Victoria, 19 in Western Australia, 15 in Queensland, six in Tasmania and three in New South Wales.
The ABCC’s compliance powers enable the Commissioner or Deputy Commissioners to compel witnesses to attend examinations to give evidence, provide information or produce documents if they refuse to do so voluntarily.
