The Code Monitoring Group (CMG) today issued a formal warning to Baulderstone Hornibrook Pty Ltd (ACN 002 625 130) for breaching the freedom of association and right of entry provisions of the National Code of Practice for the Construction Industry (the Code) and the Industry Guidelines for the National Code of Practice for the Construction Industry (the Guidelines), issued 2003.
The warning followed an audit of the Baulderstone’s practices as managing contractor on the Department of Finance and Administration’s Christmas Island Immigration Reception and Processing Centre project. Baulderstone continued to allow a union delegate, rather than site management, to conduct staff inductions.
Allowing a site delegate to undertake or administer site induction processes is inconsistent with the Code and Freedom of Association and Right of Entry provisions of the Guidelines.
The formal warning issued by the CMG does not preclude Baulderstone from tendering for Australian Government funded work. However, further breaches of the Code and Guidelines may lead to more serious sanctions by the CMG including:
