The CFMEU was engaged in protected industrial action against Boral Formwork and Scaffolding. The CFMEU placed a ban on the scaffolding being removed not only by Boral workers but also by employees of Village Park Builders.

Consequently Village Park Builders were unable to complete civil and building works on the site.

Following a hearing before DP Ives in the AIRC on 23 November 2005 the issues between CFMEU and Village Park Builders were resolved in conference.
