United Group Infrastructure commenced proceedings in the Federal Court seeking injunctive relief under both the BCII Act and the WRA. It also sought prosecution for breaches of s.38 of the BCII Act and the imposition of penalties under both the BCII Act and the WRA.

The application related to 22 incidents of alleged industrial action across the Alcoa refinery sites at Kwinana and Pinjarra.

The judge found that the balance of convenience favoured the applicant and granted an interim injunction in very broad terms that would prevent further industrial action by the union and employees involved.
