On 12 September Senior Deputy President Watson terminated two certified agreements upon application by the employer who wanted to ensure that its industrial instruments complied with the National Code of Practice for the Construction Industry.

The applications for termination of the certified agreements under s.170MH of the Workplace Relations Act 1996 (pre-reform) were filed with the AIRC in respect of two agreements which had had passed their nominal expiry date.

The hearing before the AIRC took place on 12 September. The ABCC supported the submissions of the employer that it would not be contrary to the public interest if the AIRC terminated the agreements.
