The matter concerned an application for orders pursuant to s.496 of the Workplace Relations Act 1996 to stop or prevent industrial action at the Project Magnet site at the One Steel Plant and Mine Site at Whyalla where CEPU members had refused to work overtime.

In proceedings in the AIRC, the union provided an undertaking that for the duration of the project a 56 hour work week should continue to be worked as required hours on the project.

On the basis of the undertaking provided by the union, the company withdrew its application for orders.
