On 18 August 2006, DP Ives made an order by consent that all three unions refrain from engaging in industrial action for a period of six weeks to allow commissioning of the Laverton North Gas Plant to be completed.
With the order due to expire on 3 October 2006, Siemens applied for a further order to extend the prohibition on industrial action for a further five weeks, by which the project will be completed.
On 27 September 2006 Ives DP made the further order sought by consent of the parties, on the basis that in the absence of a continuation of the s.496 order, industrial action was likely, given the history of this troubled site.
