Shedden Uhde applied for an order to stop industrial action under section 496(1) of the Workplace Relations Act 1996 on the grounds that unprotected industrial action was occurring at the Basell Australia, Geelong site.

The application concerned a work stoppage by employees of various sub-contractors, as allegedly organised and encouraged by the respondent unions.

The ABCC filed a notice of intervention in this matter. Commissioner Eames strongly recommended that employees working on the site return to work at 8am, 31 March 2006.

The CFMEU, AMWU and CEPU gave undertakings to the AIRC to the effect that there would be no industrial action at the Bassell site until the project's completion.

Commissioner Eames adjourned the matter and indicated he would issue an interim order if the undertakings were breached.
