S&K Alexander Electrical Services applied to the AIRC under s.170MH of the Workplace Relations Act 1996 (pre reform) for termination of the S&K Alexander Electrical Services Construction Industry Enterprise Agreement 2003, a certified agreement which had passed its nominal expiry date.
S&K Alexander Electrical Services sought termination in order to ensure that its industrial instruments complied with the National Code of Practice for the Construction Industry.
The ABCC Commissioner intervened in the matter and made submissions in support of the case for termination.
Senior Deputy President O’Callaghan ruled that it would not be contrary to the public interest to terminate the agreement and ordered that it be terminated.
