Roche Mining notified a dispute under section 170LW of the Workplace Relations Act 1996 on the grounds that unprotected industrial action was occurring at the Roche Mining MBDP Project relating to the payment of camp allowance.

The ABCC intervened in this matter. The following directions were made by the AIRC:

  • That to the extent that industrial action is occurring, continuing to occur, or commences such industrial action should cease and/or not occur.
  • That normal work should resume with effect from 7.00 am on 28 March 2006 without bans or limitations.
  • That the AWU through its officers should exercise its best endeavours to convey the substance of this direction to the relevant workplace representatives and employees concerned in the alleged industrial action prior to 7.00 am on 28 March 2006.
  • That the issue in dispute which allegedly relates to clause 19.3 of the Agreement be the subject of discussions between the parties in accordance with clause 14 of the Agreement.
