Application is for settlement of a dispute over the application of a certified agreement under s.170LW of the pre-reform Workplace Relations Act 1996.
The application relates to the question of what constitutes a “project” for the purposes of determining the rate of site allowance payable for work performed in constructing a series of buildings at Haileybury College’s Keysborough campus.
Rahan Constructions was successful in winning some of the tenders let by the college for the building of additional facilities to meet the school’s expansion programme.
The company is seeking a review of the decision of 19 December 2006 by the Victorian Building Industry Dispute Panel which ruled that all of the works undertaken by Rahan Constructions should be considered as a single project.
Commissioner Simmonds issued directions for the parties to file and serve submissions with dates set for a hearing, however, on 20 February 2007 the company withdrew its application and the matter was cancelled before any further hearings took place.
