PCV Electrical Pty Ltd applied to the AIRC under s.170MH of the Workplace Relations Act 1996 (pre reform) for termination of the PCV Electrical Pty Ltd Construction Division Enterprise Agreement 2003- 2005, a certified agreement which had passed its nominal expiry date.
The company sought termination in order to ensure that its industrial instruments complied with the National Code of Practice for the Construction Industry.
The ABCC Commissioner intervened in the matter and made submissions in support of the case for termination.
However, before proceedings in the AIRC had been completed the company’s application was discontinued as a result of PCV Electrical Pty Ltd being placed in administration.
