On 22 August 2006 Commissioner Simmonds terminated a certified agreement upon application by the employer who wanted to ensure that its industrial instruments complied with the National Code of Practice for the Construction Industry.
The application for termination of a certified agreement under s.170MH of the Workplace Relations Act 1996 (pre reform) was filed with the AIRC on 9 August 2006 in respect of an agreement which had had passed its nominal expiry date.
AIRC proceedings took place on 22 August. The ABCC supported the submissions of the parties that it would not be contrary to the public interest if the Commission terminated the agreement.
