Kellogg Brown & Root applied for an order to stop industrial action under s.496(1) of the Workplace Relations Act 1996 on the grounds that unprotected industrial action was occurring on the Ethane to Quenos Project. The application concerned a request from the employer for staff to volunteer to work on scheduled rostered days off.
The ABCC filed a notice of intervention in this matter.
AWU and AMWU gave undertakings to the AIRC to the effect that they would not incite, organise, encourage or persuade the Project employees to engage in industrial action for the life of the Agreement. Commissioner Eames adjourned the matter and indicated he would issue an interim order if the undertakings were breached.
