The application for an order to prevent further industrial action, under section 127 of the Workplace Relations Act 1996, was filed with the AIRC on 29 November 2005.

The parties to be bound by the proposed order were KBR, AWU, AMWU, and CEPU and employees who are members of those Unions. The application related to a stop-work meeting which, the Applicant alleged, had caused significant disruption to work at Esso facilities, including the Longford Plant, the Long Island Point Plant and offshore platforms in the Bass Strait.

KBR withdrew the application on the basis of undertakings by unions that they would provide 7 days notice in respect of future meetings.
