Deputy President Acton terminated a certified agreement upon application by the employer because it did not comply with the National Code of Practice for the Construction Industry.

The applications for the termination of the certified agreement under s.170MH of the Workplace Relations Act 1996 (pre–reform) was filed with the AIRC in respect of the Hufcor Enterprise Bargaining (Braybrook Plant) Agreement 2003 – 2006 which had passed its nominal expiry date.

The hearing befire the AIRC took place on November 21 2006. The ABC Commissioner intervened in this matter. No objections were made to the ABC Commissioner’s intervention. The ABC Commissioner supported the submissions of the employer that it would not be contrary to the public interest if the AIRC terminated the agreement.

After consideration, the AMWU agreed not to contest the application subject to agreed undertakings by the employer.
