Heinemann Electrical Pty Ltd applied for orders under s.496 of the Workplace Relations Act 1996 to stop bans on overtime by production employees at Heinemann’s Mulgrave plant.
Heinemann alleged that, following a union meeting on 16 June to discuss negotiations for a new workplace agreement, production employees refused to make themselves available to work overtime. Although a bargaining period had been initiated, the overtime ban was not protected industrial action.
At an AIRC hearing on 23 June, 2006 Heinemann withdrew its application after it reached agreement with CEPU on a statement to be provided to employees that there was no ban on overtime.
